How to Challenge Unlawful ICE Detention – Upcoming Training for Attorneys

We invite attorneys to join us for a free training on how to use habeas corpus proceedings to vindicate the rights of and win the release of clients unlawfully detained by immigration authorities.

Our CLE “Using Habeas Corpus to Challenge Immigration Detention” will take place Wednesday, July 16, at 11 p.m. P.T. on Zoom.

This training will provide:

A brief history of constitutional habeas corpus;
A description of statutory habeas corpus, including lessons learned from three areas in which 28 U.S.C. § 2241 petitions were used for non-citizens; and
An introduction to Innovation Law Lab’s recent habeas corpus work challenging unlawful detentions of immigrant Oregonians, including following courthouse arrests.

You’ll come away with knowledge about filing and litigating a habeas petition, including establishing jurisdiction, applying for emergency relief, and adapting to rapid changes in detention practices.

We will finish with recommendations for collaboration and a discussion of the need for advocates to be aware of criminal statutes and ethical constraints for protection of clients, attorneys, and organizations, including practical hypotheticals exploring how ethical duties intersect with immigration enforcement.
