Open Letter to the President of the United Mexican States, Mr. Andrés Manuel López Obrador

Mr. President:

Those hereby present, and in exercise of our right to freedom of expression, the committee representing the Central American Exodus with the support of the undersigned social organizations, unanimously declare our rejection and condemnation, in the face of serious violations of human rights and the dignity of Central American migrants, in their passage through the city of Tijuana Baja California, perpetuated by Mexican authorities, both local and federal, whom have failed to comply with their legal mandate to provide protection, and guarantee respect for the human rights of migrants, have provided them with a denigrating treatment by denying them the most basic conditions of survival in matters of food, security, health and sanitation services; situations that constitute serious violations of international norms for the protection of human rights, of which the Mexican State is a signatory.

We express our recognition of the positions assumed by the new administration led by his person in favor of respect for the dignity and human rights of migrants and we offer our collaboration and support to ensure that the efforts developed by this government are successful. Likewise, we demand from the incoming government, an attitude of coherence and reciprocity concerning the respect for the human rights of migrants, in such a way that the same conditions of respect and dignity are demanded for Mexican migrants in the United States and in the rest of the world, the Central American migrants must be guaranteed by the Mexican authorities a just migration process.

We express our most compelling and absolute rejection of President Donald Trump’s proposal, known as the Plan “Quedate en México,” which alleges for us migrants to wait in Mexico, better described as a method in which while our entry into the United States is regulated, it creates a proposal that threatens our human rights as a refugee population, and violates our rights recognized by the international legal community, to request asylum and to follow the corresponding due process within the country of destination, so that the asylum process fulfills its primordial and end purpose to guarantee the life and security of the applicants, all within the most absolute and unrestricted adherence to the international norms that protect human rights, which govern truly democratic societies.

We also inquire the release of pertinent instructions to the appropriate competent authorities so that in the ports of entry of Tapachula and Tenosique, the migratory process of the refugees is expedited for those who have been waiting for nine weeks as well as being given many rejections. We demand a halt to the hunting of migrants by the police and demand that action be taken against the authorities that violate the human rights of migrants. We urge the President to recognize the importance and include Central American migrants in Mexico within the proposals and focus of the Programa de la Zona Libre, which promises to raise the level of competitiveness, attract better sources of employment, and foster conditions ideal for the economic development of the Mexican border strip. We also ask that the proposals for work be solidified and clarified as to where and under what conditions the job would be offered.

Above all, guaranteeing the right to equality, and not tolerant of discrimination against migrants for reasons pertaining to nationality, race, or social origin. We demand for the following to be taken into account; the protection of those most vulnerable during the migration path, which are Indigenous peoples whose language is not Spanish, the LGBTQ community, women and girls, as well as unaccompanied minors.

At the local level we demand from the authorities to guarantee that the shelters will meet the basic conditions in terms of health, food, health and safety, respecting at all times the dignity of Central American migrants and other countries and allowing them to participate actively in the organization and administration of said shelters. It is also necessary to demilitarize the shelters and replace them with trained civilian personnel who understand these type of situations. The military as much as the police treat civilians as enemies or at most as prisoners, in their operations. In order to provide adequate treatment for migrants, and to that end, we ask that you make the necessary budgetary allocations for resources, and coordinate efforts with United Nations agencies specialized in refugee issues, in order to receive the necessary guidance and where said international organizations serve as guarantors of compliance with the obligations of the Mexican State in terms of respect for the human rights of refugees.

We demand transparency and integrity in the management of all resources used to address the current humanitarian crisis. We ask that the media, government auditors as well as the international community to be alert and take action in order to ensure that responsible and effective distribution of resources for the long term.

It is important that all levels of government are held accountable for any and all abuses faced by migrants. We ask that as the President of Mexico, you continue support of migrants and refugees as well oppose the anti immigrant policies of the U.S. We demand actions that uplift the respect and dignity of migrants.

Señor Presidente:

Por medio de la presente, y en ejercicio de nuestro derecho a la libertad de expresión el comité en representación del Éxodo Centroamérica con el acompañamiento de organizaciones sociales abajos firmantes, manifestamos de forma unánime nuestro rechazo y condena, frente a las graves violaciones a los derechos humanos y a la dignidad de las y los migrantes Centroamericanos ,en su paso por la ciudad de Tijuana Baja California, por parte de las autoridades mexicanas tanto locales como Federales, quienes faltando a su mandato legal de brindar protección, y garantizar el respeto a los derechos humanos de los migrantes, les han dado un trato denigrante al negarles las condiciones más elementales de sobrevivencia en materia de alimentación, seguridad, servicios de salud y salubridad; situaciones que constituyen graves violaciones a las normas internacionales de protección de los derechos humanos, de las cuales el Estado Mexicano es signatario.

Expresamos nuestro reconocimiento a los posicionamientos asumidos por la nueva administración encabezada por su persona en favor del respeto a la dignidad y los derechos humanos de los migrantes y ofrecemos nuestra colaboración y respaldo para lograr que los esfuerzos desarrollados por su gobierno sean exitosos. Así mismo, demandamos del gobierno entrante, una actitud de coherencia y reciprocidad en lo referente al respeto de los derechos humanos de los migrantes, de tal forma que las mismas condiciones de respeto y dignidad que se exigen para los migrantes mexicanos en Estados Unidos y en el resto del mundo, les sean garantizadas por parte de las autoridades mexicanas, a los migrantes centroamericanos en proceso de migración.

Expresamos nuestro más contundente y categórico rechazo a la propuesta del Presidente Donald Trump, conocido como el Plan “Quedate en México,” en lo relativo a que los migrantes esperemos en México, mejor conocido como mientras se regulariza nuestro ingreso a los Estados Unidos, por ser una propuesta que atenta contra nuestros derechos humanos como población refugiada, y vulnera nuestro derecho reconocido por la comunidad jurídica internacional, a solicitar asilo y a que se siga el correspondiente debido proceso dentro del país de destino, a fin de que el asilo cumpla su finalidad primordial de garantizar la vida y la seguridad de las personas solicitantes, todo dentro del más absoluto e irrestricto apego a las normas internacionales protectoras de los derechos humanos, que rigen en las sociedades verdaderamente democráticas.

También le solicitamos dar las instrucciones pertinentes a las autoridades competentes a efecto que en los puertos de entrada de Tapachula y Tenosique se agilicen los proceso migratorios de los refugiados los quienes llevan nueve semanas de espera y dan muchos rechazos. Exigimos el alto a la cacería de de migrantes por parte de las policías y que se actúe contra las autoridades violadoras de los derechos humanos de los migrantes. Exhortamos al Presidente que reconozca la importancia e incluya a las y los migrantes centroamericanos en México dentro de las propuestas y el enfoque del Programa de la Zona Libre, el cual promete elevar el nivel de competitividad, atraerá mejores fuentes de empleo, y propiciará las condiciones ideales para el desarrollo económico de la franja fronteriza mexicana.   También pedimos que se concrete los ofrecimientos de trabajo y se clarifique dónde en qué y bajo qué condiciones es que ofrecería el empleo.

Garantizando principalmente el derecho a la igualdad y a la no discriminación de las personas migrantes por razones de nacionalidad, raza u origen social. Queremos que tomen en cuenta las protección de las personas más vulnerables en el camino de migración, los cuales son personas indígenas cuyo idiomas no es el español, la comunidad LGBTQ, mujeres y niñas, así como también menores no acompañados.

A nivel local demandamos de las autoridades garantizar que los albergues cuenten con las condiciones básicas en materia de salud, alimentación, salubridad y seguridad, respetando en todo momento la dignidad de los migrantes Centroamericanos y de otros países y permitiéndoles participar activamente en la organización y administración de dichos albergues. También es necesario la desmilitarización de los albergues y reemplazar con personal civil capacitados para entender situaciones de este tipo. Los militares tanto como la policía trata a los civiles como enemigos o a lo sumo como prisioneros, en su formación. Con el fin de brindar un trato adecuado a los migrantes destinando para tal efecto, le pedimos que los recursos presupuestarios que sean necesarios, y coordinar esfuerzos con las agencias de Naciones Unidas especializadas en la temática de los refugiados, a fin de recibir la asesoría necesaria y que dichos organismos internacionales sirvan como garantes, del cumplimiento de las obligaciones del Estado Mexicano en materia de respeto a los derechos humanos de los refugiados.

Exigimos la más absoluta transparencia y probidad en el manejo de los recursos públicos destinados a la atención de esta crisis humanitaria, por lo que solicitamos a los medios de comunicación y a las entidades contraloras del Estado, así como a la comunidad internacional mantenerse atentas, y ejercer una permanente contraloría social sobre el particular.

Hacemos responsables a todos los niveles de gobierno por todos los abusos sucedidos. Pedimos el respaldo del Presidente de México a favor de las y los migrantes y refugiados, y proteja de las políticas anti-migratorias de Estados Unidos. Exigimos acciones que reflejen el respeto y la dignidad al migrante.
